Brandon Lozza Tries to Shut Down This Site! (And Fails, of Course)

Yesterday, Brandon Lozza went so far as to register an improperly formatted, largely incoherent and spittle-flecked complaint with this site's hosting provider, alleging that I had violated his copyright by publishing (with his prior permission) his email.

(It's worth noting that Mr. Lozza has, in fact, violated my copyright, not once but twice, by using my images without permission on his web site and on identi.ca; I was obliged to provide him with a correct DMCA takedown notice on the former; the administrators of identi.ca had words with him regarding the latter. Both situations were swiftly corrected.)

My hosting provider, to their credit, takes such things seriously, even when they appear to have been transcribed from an original written in crayon, and brought the matter to me.

I advised them that Mr. Lozza's action was moronic, given his prior permission, and supplied them with a copy of the email in which he granted it. I further advised them that my use of the email was fair, and that if Mr. Lozza felt differently, I'd be more than happy to take the matter up with him directly in court, should he wish to pursue it there.

Case closed. As we informed Mr. Lozza, "There's no medicine that cures being an idiot", sadly for him.

It's good that it wasn't a proper DMCA notice, or he would have had to perjure himself to send it, but a lie is a lie, and Mr. Lozza is clearly a liar. He's taken his various half-witted accusations toward me, including drug abuse and pedophilia (although he's provided no evidence for the former and admits that he can't prove the latter "yet") to identi.ca.

Mr. Lozza's action was clearly based in falsehood, malicious, and motivated by a desire to muzzle opinions with which he doesn't agree. It's interesting to see just what sort of "freedom" these folks believe in.

(If things run true to form, I suppose death threats will be next on Mr. Lozza's hit parade. Stay tuned.)

Contrary to the representations of Bruce "What's the problem?" Perens and others, it seems that Richard Stallman is indeed capable of issuing (or perhaps, being made to issue) an apology!
